The Will of James Appleby Jackson County, Georgia probate records Book B, page 121, 18 July 1866)
"In the name of God Amen I James Appelby of the County of Jackson & State of Georgia being of Sound mind and disposing memory and knowing that life is uncertain & that is appointed unto all men once to die do Make this my last Will & testament in the words and figures (?) following Item 1st It is my will & desire that after my death my body be buried in a Christian like manner Item 2nd After the payment of all my just debts I desire that all my Estate both Real and personal be sold & distributed by my Executors amonge my children & grand children as hereafter directed Except the bonds or Stock which I hold in the Georgia Rail Road & Banking company Item 3rd It is my will & I herby direct that my Executor retain in their hands Said Rail Road bonds during the natural life of my beloved wife Jane Appelby & that they collect & pay over to her annually the Interest or dividends accruing on said bonds or so much thereof as She may Require for her maintenance & comfort so long as She Shall continue in life and at her death to be disposed of as hereinafter directed. Item 4th I give & bequeath to my daughter Evaline Scott one Sixth part of all my Estate which I may be in possession of at my death Item 5th I give to each of my grand children that is to say to the children of my deceased daughter Carsandria Cheatham to the Children of my dcsd son James M. Appleby to the Children of my dcsd Sons William D. Appleby to the Children of my son John Appleby and to the Children of my son Hugh C. Appleby an equal share of all my Estate Real personal or Mixed after deducting the Said Share of my daughter Evaline Scott or to each of my said grandchildren as be living at my death & if dead to their children if any Item 6th It is my desire that all advancements made by me to my Several Children be taken into account in the final distribution of my said Estate Item 7th I herby appoint my sons John Appelby & Hugh C. Appleby my Executors to Cary out this Will and that they do so without being required to give bond In Witness whereof I have hereto set my hand & affixed my seal this the 18th day of July A.D. 1866 James Appleby (seal) Signed in our present on the day & date above written T.
