State of Missouri County of Greene
I, James N. Appleby of the County and State affore said do make and ordain this to be my last will and testament revoking all others. It is my will and desire that all my just debts be punctaly paid also my physicians fee and funeral expenses. 1st I devise and bequeath to my family of five children namely Elisabeth Margie Appleby Susan Adaline Appleby Catherine Bell Appleby Cyrus Duff Appleby and Benjamin Franklin Appleby, all of my house hold and kitchen furniture including evry thing in the house and kitchen also all my stock of cattle and hogs and all the provision grain and forage of evry kind also the growing crop also all my farming utential of evry kind. My two head of horses I bequeath to my three above named Daughters. I further will and bequeath to my family of five children to wit: Elizabeth Margie Appleby Susan Adaline Appleby Catherine Bell Appleby Cyrus Duff Appleby and Benjamin Franklin Appleby Eighty acres of land that is to say the East half of the North East quarter of Section thirty three (33) of Township thirty (30) of Range twenty- one (21) with all the appertinances there to belonging to them and their heirs for ever the sons to have the North half and the Daughters the South half all to have an equal interest in the buildings while they remaine in the family but if any of them see proper to leave the family then they forfeit their interest in the Buildings and only retain their interest in the land. 2nd I will devise and bequeath to my Sons Milton Bedford Applebyand George Harvy Appleby an Equal interest in the following twenty acres of land that is to say the East half of the north west quarter of the north East quarter of Section thirty three (33) of Township thirty (30) of Range twenty one (21) with all the appertinances thereto belonging to them and their heirs forever. 3rd. I will and bequeath to my Daughter Margaret Jane Garrett and my three Sons David A. Appleby Carson Appleby and William E. Appleby the West half of the South west quarter of the northwest quarter of Section (34) of Township thirty (30) of Range Twenty- one (21) with all the appertinances there to belonging to them and their heirs forever also two hundred dollars in money to be equaly divided among the four provided that David A. Appleby and William E. Appleby pay a certain note to which I am security to Mrs. AnnieFarmer, Eaer of the Estate of Osker Farmer deceased if they fail to pay Said note and my Estate has it to pay then what ever amount my Estate has to pay shall be deducted from their sheer in my Estate. I here by appoint my Sons William E. Appleby and Cyrus D. Appleby my Sole Executors to cary out the provisions of this my last will and testament and I direct that they Shall not be required to give any Bond in this case. In testimony whereof I have hereto Set my hand and affixed my Seal this 3 Day of December 1888 in the presence of J M Hall and W. N. McMurry.
